Probate in NJ and NY
Probate is a court proceeding which settles final debts and formally passes legal title to property from the estate of the deceased person to his or her heirs. Probate proceedings take place in the NY surrogate’s court or the NJ probate court (part of the Chancery Division of the Superior Court) in the county where the decedent legally resided at the time of death. If a person dies intestate, meaning without a will, state law determines how to distribute his or her property.
In the case of a decedent who left a will, it is subject to NY or NJ probate. The will is filed with the probate or surrogate’s court and notice of the probate proceeding is published in the newspaper so that interested parties, such as heirs and creditors, are given notice.
Most often, cases are uncontested and creditors and heirs receive payments according to the wishes of the decedent. However, some creditors and heirs contest cases, which is the time to seek competent legal advice.
